Unreasonable Doubt

Yesterday, I heard on the radio that a Florida jury acquitted Casey Anthony in  the 2008 murder of her child Caylee.  I was disgusted.  I pulled into the local feed store and was greeted with several "How are you's."  I replied that until a few minutes ago I was fine, and then we entered a discussion of Casey Anthony.  Everyone at the feed store was shocked that she was acquitted.

The idea that someone can kill a small child is repulsive to me.  Having four small children, I know there are times when they can challenge your sanity.  I know there are times when you can get madder than you should.  I cannot sympathize with anyone who accidentally kills their child, but I can understand that it can happen.  But it is abominable to me that you would try to cover up the accidental death of your child by throwing their body out in the woods.  Certainly you were mad at them at the moment of their death.  But just as soon as that accident happens, a normal human would be overcome with love for that child.  How could you then deny that child a proper burial?  The only answer to that is because you are a monster.

When a jury is deciding on a verdict, they are required to find the accused guilty as charged unless they have a "reasonable" doubt.  I think the jury in Florida was confused by the definition of reasonable doubt.


REASONABLE DOUBT

The level of certainty a juror must have to find a defendant guilty of a crime. A real doubt, based upon reason and common sense after careful and impartial consideration of all the evidence, or lack of evidence, in a case.
Proof beyond a reasonable doubt, therefore, is proof of such a convincing character that you would be willing to rely and act upon it without hesitation in the most important of your own affairs. However, it does not mean an absolute certainty.

Reasonable doubt means that there is a conflicting point in the witnesses testimony.  Taking the trial in question, one reason to have reasonable doubt would be the testimony of Cindy Anthony.  She testified that she was the one who used the home computer to search for chlorophyll.  Doubt, however, arises when Cindy's boss testified that she was logged in on her computer at work when the search was made.  Now, having reasonable doubt that Cindy made the search for chlorophyll, one must assume that someone else made the search.  The prosecution provided a preponderance of evidence that that someone was Casey Anthony.

Unreasonable doubt can be achieved by the defense's claim that George Anthony molested Casey as a child. Not only is it irrelevant to the case, but their was no corroboration by any other witnesses.  Therefore, it is unreasonable to put any weight in that corner.

The whole thing is disgusting.  Casey Anthony's parents fought the prosecution at every turn.  In a normal murder case, the victim's family is on the prosecution's side.  In this case, Caylee Anthony stood alone.  Because the identity of her father is a mystery, she didn't even have the support of her paternal ancestors.  The whole situation is a sad documentary of the downfall of this country.  Grandparents raising children is obviously a bad deal.  If they were good at raising children, their kids would be raising their own children.

    Kid missing for a month while saying nothing?

    Kid "drowned" in the pool and nobody calls an ambulance?

    And, before that the story was that the kid was stolen by a fucking babysitter a month prior!

    Casey Anthony (as well as her vermin family) need to take a fast bath with a hair dryer.

    Stupid Americans will buy those books. This whole thing is so repulsive, and people like Hannity and Geraldo agreeing with the jurors is really blowing my mind. It is baffling.

    Welcome back. I had heard rumors from some of your fans that you had "left" us.

    I guess no one ever reads The Boy Who Cried Wolf to kids anymore. Casey Anthony certainly never heard it. I am most disgusted by the lack of victim support for little Caylee. Her whole family abandoned her to support her murderer. Disgusting.

  5. I think that this has been a long time in coming. There hasn’t been anything done outside science to improve the opportunity for justice in our system. It seems that every time they change the legal code they advantage the criminal.

    I heard one pundit opine that the prosecution had to go for the death penalty to lower the chance of getting buffoons on the jury. He was gaming the system. Perhaps they wanted to prevent Casey Anthony from getting a jury of her peers – twelve psychotic, narcissistic, pathological lying, and immoral lunatics.

    I mostly blame the judge for allowing the outrageous antics of the defense lawyers in blaming Papa Anthony for any number of crimes without a shred of evidence. At a minimum he should have instructed the jurors to ignore any such allegations that were unproven.

    I think that my wife offered the only logical solution. That entire dysfunctional family should be locked up together in one cell and we should throw the key away.

    At a minimum – some of them committed perjury and they should be prosecuted to the full extent of the law.

  6. No, I didn't leave nor, do I plan to leave. Just had a silly episode with one of muckrake's more bi-polar stalwarts from his site.
    According to the entire "never served a day in the military" crowd over there, it's "impossible" to have had 3 different MOS's over 3 different enlistments and, as an artillery guy...speak foreign languages too!

    A bunch of kiddie drama from the wishfull thinking squad over there.

    I've been arguing politics with muddy for close to 10 years and it's stayed pretty civil until he got lazy and handed his blog over to the mentally ill arm of leftism to run it.
    Now the place has a chief moonbat who posts under one name and answers himself under another.
    I limit my visits now to just chime in and watch them shit frisbees for hours...all in the name of fun.

    As for Caylee Anthony, it's just a symptom of how jacked up this country has become.

    I got caught up in a little of that argument. In one four year enlistment in the Marine Corps, I was an infantryman, a chaser, a marksmanship coach, a hand to hand combat instructor, and a water safety and swimming instructor. I also had to beg the Corps NOT to send me to Arabic language school, a decision I have had opportunity to second guess. I passed every test they made me take in boot camp, but all I wanted was to be a basic rifleman.

    I think the judge could have done better in keeping Baez from throwing out so much BS, but the jury should have been able to conclude that a poor childhood is no excuse for murder. Sad.

    Dershowitz? That is the guy who will cause you pause? Casey killed her daughter, and the prosecution proved that beyond a "reasonable" doubt. To say otherwise is putting undue burden on the prosecution. The defense used the "Wookie" defense and the stupid jurors bought into it. And the judge let them. The judge should overrule their finding and call a mistrial

  11. Well 10th - I have sat on many a jury and it isn't as easy as it might at first appear. True - the juries I sat on were all military trials and they tend to be more logical and less theatrical than civilian trials (shorter too) - but that didn't make the whole guilt-innocence thing any easier.

    I consider Casey Anthony guilty of something - but like those jurors, I'm not sure what.
